GENERAL CONDITIONS
Julien Delaval (hereinafter "the Author") offers his Clients (hereinafter "the Client") the sale of Art Prints.
Any order implies on the part of the Customer unreserved acceptance of these general conditions of sale, which the Customer acknowledges having read.
Type of Products and Services
Art Prints are original works of art. These prints are signed, numbered, with a maximum limit of 25 copies in all formats and media. They are printed by a professional under the supervision of the Author. They benefit from the tax status of works of art within the meaning of Article 98A of Appendix 3 of the General Tax Code. The miniatures used in the store to visualize the type of finish (print only, framed print, dibond, American box) are non-contractual illustrations and are provided to the Customer for information purposes. They are nevertheless intended to be representative of the Product.
The Transfer of Reproduction and/or Representation Rights of the photographs is understood for a specific and determined use at the time of the quote. The price is calculated based on several criteria to assess the importance and scope of the distribution such as the type of distribution method, the print run or number of copies for printed use, traffic for a website, the proportions of the photograph in the document and its location, the duration of use and the distribution territory.
Pricing and Shipping
Prices may be changed without notice. All orders are payable in euros (€). The products ordered are billed according to the prices in effect at the time the order was registered and remain the property of the Author until payment of the order. Payment for purchases is made when ordering by credit card in the case of online payment or by check or transfer to the Author in the case of offline payment. In the latter case, and unless otherwise stated by the Author, the products are only delivered upon full receipt of payment, which may result in an additional delay.
For Art Prints, participation in shipping costs in Metropolitan France, packaging and processing are included in the displayed price. In the case of shipping outside Metropolitan France, these shipping costs are adjusted according to the type of print.
In the event of an order for the product(s) concerned to a country other than a country of the European Union, the Customer is the importer of these products. Customs duties or other taxes may be required by the countries concerned. These taxes are not the responsibility of the Author and are the responsibility of the Customer.
The Author does not commit to a specific delivery time but undertakes to keep the Customer informed of the progress of the print and its shipping. Generally speaking, the delivery time observed is ten to twenty days for Art Prints.
However, in certain cases (very large formats, special finishes, etc.) the delay may be longer.
The invoice corresponding to the order is always sent in electronic format to professional customers, and to individuals if they request it. In the case of an order for an Art Print, a certificate of authenticity signed by the author is sent to the Customer in paper form.
The risks of deterioration related to transport are the responsibility of the carrier. The Customer must, in the event of damage to the package, refuse to validate the delivery with the carrier, notify his reservations on the delivery note, and within three days, send a registered letter to the carrier, with a copy to the Author.
The Author cannot be held responsible for late delivery times or non-delivery due to loss of the package. No compensation may be claimed for late delivery or for a damaged print due to the carrier.
Delivery will be made to the delivery address that the Customer indicated when ordering. Any return of the order due to the Customer (error in entering the address when ordering) will be at the customer's expense.
In application of article 1148 of the Civil Code, the Author cannot be held responsible for the non-performance of the sales contract due to a stock shortage, unavailability of the product, in the event of force majeure (strike, total or partial, in particular of postal services or the carrier, disaster, etc.)
Return of Products
If an ordered Product does not match the order (eg type of photo, size or finish, the order form or the exchange of emails being authentic) or if it presents defects related to the Product itself, the Customer has a right of return. The Customer informs the Author of the non-conformity of the item. He imperatively returns it in its original packaging. The Product is, in this case, exchanged by the Author who takes care of both the return costs incurred by the Customer and those related to the delivery of the new shipment.
The Art Prints offered for sale remotely from the website www.juliendelaval.com are not in stock and are made to order according to the Customer's specifications (choice of size, support, finish) when ordering. If the Customer changes his mind after ordering, the right of withdrawal provided for in Article L121-20 of the Consumer Code cannot be exercised by the Customer, in accordance with Article L121-20-2 of the Consumer Code.
However, by way of exception to this article, the Author grants individual Customers a maximum period of 2 calendar days after placing an order to obtain a refund without having to provide a reason or pay penalties. Professional Customers are excluded from this exception.
To benefit from this right of withdrawal, the private Client must first contact the Author quickly.
The parties agree that these terms of sale are subject to French law. In the event of a dispute, the Customer and the Author undertake to seek an amicable solution. Otherwise, the dispute will be brought before the competent court of Avignon. Any return of an order due to the Customer (error in entering the address when ordering) will be the responsibility of the customer.
